Right of withdrawal

Pursuant to art. 52 of Legislative Decree 6 September 2005 n. 206 (“Consumer Code”) you have the right to withdraw from the contract signed without any penalty and without having to provide any reason, within fourteen (14) days from the day you received the products purchased on this site.

Pursuant to art. 54 of the Consumer Code, the right of withdrawal can be exercised using the Return Form (compliant with the standard form, pursuant to art. 49, paragraph 4 of the Consumer Code) that you can find by clicking here and to be completed in full. We will send you confirmation by e-mail of the receipt of the withdrawal request sent.

The products to be returned must be delivered to the courier within fourteen (14) days from the date you notified us of your decision to withdraw from the contract.

Pursuant to art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased custom-made or customized products, in the case of perishable goods or sealed goods that do not lend themselves to be returned for hygiene reasons or connected to health protection and newspapers and magazines have been opened after delivery (however, it is possible to withdraw from a subscription)

I. Conditions for exercising the right of withdrawal pursuant to art. 52 of the Consumer Code

The right of withdrawal is exercised correctly if the following conditions are fully met:

  • within fourteen (14) days of receipt of the products you must correctly complete and send us the Return Form (or alternatively send another explicit declaration of your decision to withdraw from the contract) by registered letter or PEC (or any other means of certification of the origin of the declaration and proof of receipt);
  • the products must not have been used or damaged;
  • the products must be returned in their original packaging (if any);
  • returned products must be delivered to the chosen courier within fourteen (14) days from when you communicated your decision to withdraw from the contract;

If you have complied with all the required conditions, pursuant to art. 56 of the Consumer Code you will be refunded in full the price of the products purchased, only the costs of the return being your responsibility, that is to say those for the return of the products purchased.

You will be contacted if your return cannot be accepted because it does not comply with the conditions set out in points “1” and “2” of the previous paragraph. In this case, you can choose to have the products purchased back at your expense. If you refuse this shipment, we will reserve the right to retain the products and the amount corresponding to the purchase price of the products.

You will also be contacted if your return cannot be accepted because it does not comply with the conditions set out in points “3” and “4” of the previous paragraph. In this case, you can choose whether to accept the reduction of the refund (which will be communicated to you) due to the decrease in value of the returned products, or if you choose to have the products purchased back (the new shipping costs will be borne by you). If you refuse this shipment, we will reserve the right to withhold the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.

II. Refund times and methods

In accordance with art. 56, paragraph III of the Consumer Code, only after we have received your return and checked that all the requirements have been met, will you receive an e-mail confirming acceptance of the return and we will proceed to a full refund, or, if the if there is a decrease in the value of the returned products, you will receive an e-mail in which you will be notified of the amount deducted by way of reduction of the refund and we will proceed to refund the amount due. The refund will be activated in the shortest possible time, and in any case within fourteen (14) days from the date on which we became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal took place in compliance with the above conditions.

THE ODR PLATFORM FOR THE RESOLUTION OF ONLINE DISPUTES

The European Commission has established a new platform specifically created for dispute resolution (ODR) for consumers who have encountered problems related to an online purchase: in particular, the ODR platform offers an access point for consumers and professionals who wish to resolve out-of-court disputes related to cross-border e-commerce transactions.
